El Tribunal Administrativo de Cundinamarca ha decidido analizar la demanda que busca invalidar el nombramiento de Gustavo Bolívar como director del DPS.
El Tribunal Administrativo de Cundinamarca ha decidido analizar una demanda contra el director del Departamento de Prosperidad Social (DPS), Gustavo Bolívar. Esta demanda busca invalidar el nombramiento de Bolívar como director del DPS.
La demanda sostiene que el decreto 280 del 5 de marzo de 2024, que formalizó dicho nombramiento, presenta varias irregularidades en su proceso, por lo que debe ser anulado.
“El acto demandado está viciado de nulidad, ya que no se publicó previamente el acto de nombramiento en encargo de Iván Enrique Fernández Pérez ni la finalización de dicho encargo“, se argumenta, en la demanda.

Sin embargo, el Tribunal no aceptó la medida cautelar que buscaba suspender provisionalmente a Gustavo Bolívar mientras se resolvía el caso. De acuerdo con el Tribunal, no se cumplen los requisitos para tomar dicha medida.
Pues, en la resolución, se establece que se recolectarán pruebas documentales y testimoniales para determinar si hay fundamentos para anular el nombramiento de Bolívar. Además, existe otra demanda en el Consejo de Estado en contra de Bolívar, argumentando que no cumple con los requisitos académicos ni de experiencia para el cargo.

“Se ha evidenciado que el nombramiento se hizo sin que el designado reuniera los conocimientos y competencias exigidos por la Constitución, la ley, los reglamentos y el manual de funciones y competencias laborales, vulnerando el principio de igualdad y configurando una desviación de poder por parte del Gobierno nacional encabezado por el presidente de la República”, indica la demanda.
